1. Introduction – Who We Are and How to Contact Us

1.1. Welcome to shishanow.ae (“Website”).

1.2. This Website is operated by Alhaj Coal Trading, a Fujairah registered company with trade license number: 1017515 (hereinafter referred to as “Shisha Now”, “we”, “us”, “our”).

2. Our Terms and Conditions

2.1. These Terms and Conditions (“Terms”) govern your use of the Website. Please read them carefully.

2.2. They will also govern any purchase you make via the Website for the following Services:

  • 2.2.1. Shisha Rental Service
  • 2.2.2. Shisha Catering Service

2.3. These Terms do not apply to B2B services which are subject to separate contractual terms.

2.4. By using and/or purchasing from this Website, you agree to these Terms. If you do not agree, you must not use the Website.

2.5. Users must be 18 or over and the services are intended for existing smokers located in Dubai. We reserve the right to limit access if we suspect a user is underage. Proof of age will be required upon delivery; purchases by underage individuals will be void.

2.6. Our Privacy Policy also applies to the use of the Website. Access it here.

2.7. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding your use of and purchase of Services via the Website.

3. Accounts

3.1. To access certain features, users may need to create an account using an email address (“Account”). Purchases can be made without creating an account using the guest checkout option.

3.2. When creating an account, you must provide accurate information and not impersonate any person or entity.

3.3. Use strong passwords and keep your login details confidential. We are not responsible for misuse due to weak passwords or failure to maintain confidentiality.

3.4. We may:

  • 3.4.1. Suspend your Account
  • 3.4.2. Cancel your Account
  • 3.4.3. Edit your Account details

at our discretion if we believe the Account is misused or violates these Terms.

3.5. Keep your details up to date via Account settings.

3.6. You may cancel your Account at any time through Account settings or by contacting us.

4. Third-Party Sites

4.1. The Website may include advertisements and links to third-party websites (“External Sites”). We do not endorse or control External Sites and are not liable for their content or performance.

4.2. External Sites may collect your data and send cookies. Review their terms and privacy policies. Access External Sites at your own risk.

5. Changes to These Terms

5.1. We may amend these Terms at any time by posting updated Terms on the Website.

5.2. Continued use of the Website following amendments indicates your agreement to the revised Terms. Check these Terms regularly for changes.

5.3. We may change, update, or discontinue certain features of the Website. We are not obligated to store or maintain any content you provide.

6. Prohibited Activities

6.1. Users agree not to:

  • 6.1.2. Post, upload, or transmit prohibited material
  • 6.1.3. Upload protected material without consent
  • 6.1.4. Misuse our brand, logo, or trademarks

6.2. We will report breaches to law enforcement and disclose your identity as necessary. Breaches result in immediate termination of use.

7. Content & Ownership of Intellectual Property Rights

7.1. Shisha Now’s Content and IPRs

  • 7.1.1. We own or license all IPRs on the Website content.
  • 7.1.2. Unauthorized use of this content violates these Terms and applicable laws. Content and features may change without notice.

7.2. Your Content and Shisha Now’s Right to Use Your Content

  • 7.2.1. We may ask for feedback and user-generated content.
  • 7.2.2. By submitting content, you assign IPRs to Shisha Now and waive moral rights.
  • 7.2.3. We may use your content as deemed necessary without compensation.
  • 7.2.4. Content use includes copying, displaying, distributing, modifying, and creating derivative works.
  • 7.2.5. We reserve the right to remove or block any content deemed objectionable.
  • 7.2.6. We are not obligated to return submitted content.

8. Order and Payment Process

8.1. Place orders by selecting services and completing checkout. Prices include 5% VAT. Shisha Now may change prices without notice.

8.2. Prices include delivery.

8.3. Equipment remains Shisha Now’s property. Disposable hoses and tobacco consumables do not need to be returned.

8.4. Order completion is confirmed via email.

8.5. Payment can be made by cash or card on delivery.

8.6. Refusal to accept delivery may result in account suspension.

8.7. Hotel delivery requires a cash security deposit of AED 500. The deposit is returned upon equipment return. Damaged equipment may result in deductions.

8.8. We are not responsible for delivery delays due to incorrect details or unavailability. Double-check delivery details and availability.

9. Cancellation, Returns, and Refunds

9.1. Contact your delivery driver or our customer service to cancel or amend an order.

9.2. Cancellations within 48 hours may incur charges unless:

  • 9.2.1. Equipment is defective or damaged upon delivery.
  • 9.2.2. Provide photographic evidence and retain packaging.

9.3. Shisha Now is not liable for equipment or product damage after delivery.

9.4. Persistent cancellations or bad faith use may result in restricted access.

9.5. Failure to return equipment within 24 hours incurs a daily penalty up to 4 days.

9.6. Unreturned equipment incurs a fee of AED 1,000.

9.7. Return charges for unreturned or damaged equipment:

  • Shisha (whole or part) – AED 1,000
  • Shisha Bottle – AED 100
  • Charcoal Heater – AED 100
  • Shisha Head – AED 50
  • Kaloud – AED 50
  • Charcoal Clips – AED 20

10. Warning

10.1. Users are responsible for safe use of equipment post-delivery. Follow instructions here.

10.2. Shisha Now is not liable for property damage or injury due to improper use.

10.3. Do not leave equipment unattended. Switch off heaters immediately after use.

10.4. Users acknowledge the risks associated with smoking and nicotine use.

10.5. Shisha should not be used by individuals:

  • 10.5.1. Under 18 years of age
  • 10.5.2. Allergic to nicotine
  • 10.5.3. Medically advised against tobacco or nicotine
  • 10.5.4. With unstable heart conditions, severe hypertension, or diabetes
  • 10.5.5. Pregnant or breastfeeding

11. Liability

11.1. We are liable for foreseeable loss and damage directly caused by us.

11.2. We do not exclude or limit liability where it is illegal to do so.

11.3. Subject to sections 11.1 and 11.2:

  • 11.3.1. The Website is provided “as is”. No warranties are made regarding quality, fitness, performance, or non-infringement.
  • 11.3.2. We do not guarantee uninterrupted, secure, or error-free Website use.
  • 11.3.3. The Website may not be secure or free from bugs or viruses.
  • 11.3.4. Users are responsible for virus protection and device security.
  • 11.3.5. Shisha Now is not liable for altered or corrupted transmitted information.
  • 11.3.6. Access may be suspended for maintenance or unforeseen downtime.

11.4. We may:

  • 11.4.1. Investigate Website use to comply with laws and regulations.
  • 11.4.2. Terminate access and suspend accounts for violations.

12. General

12.1. Severability: If any paragraph is deemed illegal, it will be replaced or restricted to the legally permissible content. The rest of the Terms remain in effect.

12.2. Waiver: Delayed action does not prevent future enforcement.

12.3. Transfer of contract: We may transfer the contract to a third party. You will be informed if this occurs.

12.4. Third-Party Rights: These Terms are between users and us only; no third-party rights are granted.

12.5. Force Majeure: Shisha Now is not responsible for performance delays due to events outside reasonable control, including acts of God, internet failure, service errors, or other unforeseen events. We may postpone, cancel, or refund in such cases.

12.6. Governing Law and Jurisdiction: These Terms are governed by DIFC laws. The DIFC Courts have jurisdiction over disputes. Civil Courts of Dubai may be used if mandated by law.
